U.S. Supreme Court After Justice Stevens:  What Will Change for Business Litigation?

Retiring after a remarkable tenure on the Court that spanned seven Presidents and three Chief Justices, Justice John Paul Stevens leaves behind a giant legacy on a wide range of issues.  One of the few trial lawyers to sit on the Supreme Court in recent years, he brought to the bench keen knowledge of procedure, deep understanding of records, and special expertise in areas like antitrust.  On the eve of the new Supreme Court term, the first without him in 35 years, what will Justice Stevens’ retirement mean for upcoming cases and trends in the nation’s highest court?

Panelists:
Susan R. Estrich, a nationally renowned law professor at Harvard and USC Law Schools and a widely recognized columnist and television commentator on legal and political issues, is partner at Quinn Emanuel Urquhart & Sullivan in Los Angeles. The first woman president of the Harvard Law Review, she was a law clerk to Justice Stevens in 1978-79.

Jeffrey L. Fisher, an associate professor at Stanford Law School and co-director of its Supreme Court clinic, is a leading Supreme Court litigator whose landmark wins include Blakely v. Washington, Crawford v. Washington, and Kennedy v. Louisiana.  Former co-chair of the appellate practice at Davis Wright Tremaine, he clerked for Justice Stevens in 1998-99.

Kathleen M. Sullivan, former Dean of Stanford Law School, is partner and chair of the appellate practice at Quinn Emanuel Urquhart & Sullivan in New York and Silicon Valley.  Her Supreme Court wins include freeing the interstate shipment of wine and limiting arranger liability under CERCLA.  She has followed the Supreme Court closely for 25 years as a constitutional law professor at Harvard and Stanford.
